If an employee is dismissed, with or without notice, or if the employee's fixed term contract expires, unless the employment has lasted for less than twenty four months, he or she is entitled to receive on request a written statement of the reasons for the dismissal within fourteen days. Failure to either provide the written statement without reasonable grounds to an employee who is entitled to receive one, or failure to give adequate or true reasons within the statement gives the employee the right to present an employment tribunal claim for which the successful remedy is two weeks' pay and possibly a declaration as to the real reasons for the dismissal.
The written statement is admissible in evidence at any possible future Employment Tribunal hearing of Unfair Dismissal, it is vital that the content of the statement is accurate and comprehensive.
